1. General, Scope
The following Terms and Conditions (T&Cs §305 ff.) apply to all business relationships with clients.
These terms apply to all transactions, contracts, and offers, as well as the services provided between the studio and its owners, Thuy-Nhi and Thuy Vi Lam, and the clients. Exceptions to transactions not covered by these terms must be communicated in writing.
In addition, the version valid at the time of the conclusion of the contract shall apply.
1.1 Place of Performance
The place of performance for the services is the studio at the following address:
(Owners: Thuy-Nhi and Thuy Vi Lam, Milchstraße 9, 81677 Munich).
The owners act together as service providers.
1.2 Client Obligations
The client is obliged to inform the service provider about any contagious diseases or infections (such as HIV, Hepatitis, etc.), allergies, or potential problems during previous treatments and to answer any inquiries truthfully. At the same time, the service provider guarantees confidentiality regarding any known diseases or infections. The service provider reserves the right to refuse treatment if there is a risk of danger (infection, etc.) to the service provider or others, or if there are medical or hygienic reasons not to perform the treatment. In case of uncertainty, the client can send a picture in advance to avoid inconvenience.
2. Services
The service provider will perform their services to the best of their knowledge and ability and in accordance with the latest industry standards. Should any changes to the standards occur, the service provider will inform the client before starting the service.
The scope of the treatment is based on prior individual consultation. The treatment will be carried out professionally and appropriately following the service provider's recommendation and the prior consultation.
3. Appointment Booking and Conclusion of Contract
Appointments are bindingly assigned by the service provider. By booking an appointment for one of the services, the client agrees to the acceptance of the contractual offer. Should it be necessary to cancel or reschedule a confirmed appointment, the client must inform the service provider as soon as possible, but at least 48 hours before the appointment. If the appointment is not canceled in time or not at all, the service provider is entitled to charge the client for the loss of earnings in accordance with § 615 BGB.
If the client is unable or unwilling to attend the agreed appointment, the following applies unless otherwise agreed:
a) Timely cancellation has no consequences.
b) If the client is late, the missed time will only be made up if it does not interfere with the schedule (generally, a tolerance of up to 15 minutes applies). If possible, 3 a) applies. If not, the deposit will be retained, and a new appointment must be scheduled.
c) If the client does not show up without cancellation, the deposit is forfeited, and no further appointments will be made.
Cancellations can be made by phone, Instagram, WhatsApp, or email.
Appointments can be rescheduled a maximum of two times. If a service provider cannot keep an appointment due to circumstances beyond their control or force majeure, the client will be informed immediately, provided contact information is available. In such cases, I am entitled to reschedule the appointment at short notice or withdraw from the contract. My statutory rights of withdrawal and termination remain unaffected.
4. Tardiness
If the client is late, the missed time will only be made up if it does not interfere with the schedule (generally, a tolerance of up to 15 minutes applies). If the client does not show up without canceling, the deposit is forfeited, and no further appointments will be made.
If the delay exceeds 15 minutes, a fee of €10 will be charged. The design may need to be adjusted due to the lost time.
If the delay exceeds 30 minutes, the appointment and deposit will be forfeited, and a new appointment must be scheduled.
In these cases, refunds are excluded.
5. Prices, Payments, and Payment Methods
The prices for services and products must be communicated when booking the appointment.
Price increases must be announced at least 30 days before they take effect. The client must pay for the service or product immediately after the treatment or purchase. Payment methods are limited to cash or PayPal on-site.
6. Legal Age
The client must be of legal age as defined by § 2 BGB when attending the appointment. Otherwise, a legal guardian must accompany the client.
7. Personal Data, Privacy, and Confidentiality
The client guarantees that they will provide all personal data and information, such as allergies, intolerances, or medical conditions, relevant to the professional performance of the required service to the service provider.
This data will be stored in the client file either in written or electronic form. The service provider commits to using this data only for the purpose of providing the requested service, considering privacy laws, and will not share the data with third parties or external individuals without the client's written consent.
8. Liability
The service provider cannot be held liable if the client suffers harm from a service based on insufficient information provided by the client. This applies particularly, but not exclusively, to physical conditions, allergic reactions, intolerances, medical or medication-related requirements, or activities outside the studio.
The studio is liable for damages resulting from contractual breaches, breaches during contract negotiations, or illegal actions only in cases of intent or gross negligence. This does not apply to damages resulting from injury to life, body, or health or for breaches of essential contractual obligations or guaranteed characteristics. The client consents to nail treatments in the studio.
9. Warranty
The service provided by the service provider comes with a 7-day warranty, which applies to the material or durability. This warranty is void if:

The client allows the service to be treated or filled by another studio.

The client comes into contact with chemicals or works with them without gloves.

The client improperly removes the nail enhancements.

The client uses products other than those recommended by the studio for nail/eyelash/skin care.

The client fails to seek medical assistance in emergencies.

The client does not follow usage instructions for products.
Changes to the design after repair are excluded.
10. Damage and Theft
The studio reserves the right to demand compensation for any damage caused by the customer. Any theft will be reported to the authorities.
11. Complaints and Refunds
If the customer has a complaint or refund request regarding the service or product, this must be communicated during the treatment. Once the treatment is completed, there is no right to a refund.
12. Nail Art
The nail art examples, color charts, and other materials displayed in the studio serve as visual references. Minor variations in colors and patterns may occur during application. The copyright for all designs remains with the service provider. If the customer takes photographs of the created design for commercial purposes, written consent from the service provider is required. Failure to do so may result in the studio asserting appropriate claims.
The same applies to all eyelash and eyebrow treatments. The sample images displayed in the studio may slightly vary in application.
13. Photos and Videos
The service provider is permitted to take photos and videos of the work during the treatment to share on their social media platforms. By booking an appointment, the customer consents to this. The service provider commits to using these images (photos/videos) only for the purpose of promoting their services. Personal data will remain private upon request.
14. Conduct
The customer agrees to maintain appropriate behavior during their visit to the studio. Should the customer continue to behave inappropriately after being warned, the service provider/owner reserves the right to expel the customer from the studio and, if necessary, issue a ban.
More than one accompanying person is not desired for appointments.
15. Severability Clause
Should any provision of this agreement be invalid, either in whole or in part, or lose its validity in the future, the remaining provisions will not be affected. In place of the invalid provision, the relevant legal regulations shall apply.
For legal disputes, the jurisdiction shall be the location of the nail studio. The applicable law will be determined based on the studio’s location.
These General Terms and Conditions apply exclusively to the studio "The Beauty Artistry," Milchstraße 9, 81677 Munich, and are protected by copyright according to Art. 2 Sec. 1, No. 1 of the Copyright Act.
